Biomedicine scores another victory against CREMESP – Dr. Ana Carolina Puga, named in the case, comments

It is not new that the Regional Council of Medicine of the State of São Paulo (CREMESP) has been trying, unsuccessfully, to make it impossible for biomedical professionals to perform aesthetic procedures. As expected, Biomedicine scores another victory against CREMESP, which this time directly includes the name of Dr. Ana Carolina Puga, regarding the legality of the profession's work in the aesthetics field and the teaching of related courses.

The case concerns the dispute between physicians and biomedical professionals in the field of aesthetics. While CREMESP seeks to restrict the work of biomedical professionals, Dr. Ana Carolina Puga's defense argues that her practices comply with the regulations of the Federal Council of Biomedicine, a right won 15 years ago.

The judge denied the request for an urgent preliminary injunction filed by CREMESP, stating that the council's claims lack plausibility. The decision highlights that Dr. Ana Carolina Puga is duly qualified and regulated to perform aesthetic procedures, and has the necessary training and specialization.

Furthermore, CREMESP's legitimacy to decide on medical education and the inclusion of Dr. Ana Carolina Puga in the case is questionable. The defense also challenges the claim of harm to the public, suggesting that CREMESP's motivation is to preserve the market for physicians.

Biomedicine scores another victory against CREMESP

The Legal department of Nepuga/Fapuga, represented by attorney Karina Mendes, brought us in the article published last week, the outcomes of this case won by Dr. Ana Carolina Puga and the Regional Council of Biomedicine.

With the case's repercussions, Dr. Ana Carolina Puga revealed that it put her on alert because, besides CREMESP wanting to interfere with her work and that of other aesthetic biomedical professionals, they sought to undermine Dr. Ana's right to do one of her passions: passing her knowledge on to other health professionals.

“I was worried. After all, this time they went beyond what we could have imagined, because they didn't just want to stop me from performing procedures, they were trying to curb my right to teach, to forbid me from doing what I have done for more than 24 years, teaching in the health field. So, I can say that yes, I was worried, but I trust in GOD and in the people HE empowered to be with me in this fight. I had a prepared and efficient legal team.”

Despite the relentless attacks, Dr. Puga remains firm in fighting misinformation about the rights of aesthetic biomedical professionals and in helping other biomedicine professionals so that everyone can work with peace of mind, confident that there are people actively working to protect the gains made so far, with an eye on new possibilities.

“I have been in this fight for approximately 20 years and I can say that it is not over. There have been many battles, and over these years each one has made me stronger and more confident in the biomedical profession. Since I learned what biomedicine was, I can say I have always had in mind making a difference in this profession and always growing together”, and she continues:

“Aesthetic Biomedicine is one of the many areas of this profession that grows every year. After these roughly 15 years since our victory, I can say that both in the field of Aesthetic Biomedicine and in Biomedicine in general we have a lot to evolve. I see the aesthetics field becoming more and more specialized in small areas, with specialists in the face, in hair (trichology), in the body and even an interface between aesthetics and the integrative field, which is growing worldwide. In addition, we have many other possibilities within this and other areas that I will be sharing with everyone soon. I can say there is a lot of news to come”.

In light of this news, Dr. Ana Carolina offers some advice to aesthetic biomedicine professionals.

“We must never be complacent. We must be prepared, ready for any attack, because others will certainly come. But we need to be with people who can truly help us, people who want to see aesthetic biomedicine grow, and not always the people we think can help us will really help us. Only those who have felt our fight firsthand can truly be at the front of these battles, so my advice is: join the strong to win, join the experienced and those who truly want the best for this field. And that I know… that I can help you with. Don't despair if you receive a notification from any medical body or when you face any kind of attack. I will make whatever time is needed to defend us. My help is always available to you”.
